Both parties filed bills of complaint for the appointment of receivers in Circuit Court No. 2. They stated that the business has been eminently successful financially, but that such differences have arisen between the partners as to the management of the business that it is no longer possible for them to continue to conduct business together without serious loss to both. Lancaster New Era (Lancaster, Pennsylvania) December 22, 1898 _______________________________________________________________________________________ RAN ELEVATOR THROUGH FIRE _________________________ Girls Carried Down From E. Pack- ham, Jr., & Co.'s Burning Warehouse. The warehouse and stock of Messrs. E. Packham, Jr., & Co., trading as the Baltimore Cork Company, at 14 Light street, were badly damaged by fire and water yesterday morning. The flames started in the basement, near the front of the building, and quickly ran up the elevator shaft to each floor. Forty-five boys and girls, at work on the fourth floor, were gotten out in safety through the presence of mind of Foreman Barnett. A number of the girls were carried to the first floor by the elevator, which was run down through a mass of flames. Others went down by the stairway. Fore some time workmen of the Consolidated Gas Company have been equipping the building with large supply pipes. They had a large supply pipes. They had a large hole in the street in front of the house yesterday. At 11 o'clock one of the men went into the cellar of the building, and shortly afterward an explosion was heard. Mr. Harry Jones, of Clarke & Jones, whose store is on the opposite side of the street, heard the explosion, and immediately turned in an alarm from box No. 5. Shortly afterward he saw Casper Rateman, an office boy, run from the burning building, carrying several books. The lad fainted shortly after reaching the street, and was carried into the store of Messrs. Clarke & Jones. When the fire department arrived on the scene, a minute later, the upper part of the building was in flames. Chief McAffee, who directed the work of the firemen, sent in a second alarm. It was some minutes before the the large ladders of the truck companies could be put into position, owing to the many wires strung across Light street at this point. Adjoining the building occupied by Messrs. E. Packham, Jr., & Co., on the south, is a five story warehouse occupied by Messrs. W. J. Dickey & Sons. It was thought at first that this building would not escape, but the prompt attack of the firemen on the burning structure prevented the fire from extending. Messrs. Dickey & Sons, however, suffered considerable damage by water and smoke. Only buildings in the vicinity were only slightly damaged by water. Messrs. E. Packham, Jr., & Co. carried a complete stock of bottles, corks and fancy novelties in glass for the liquor trade. They estimate their loss at from $10,000 to $15,000, which is covered by insurance, of which $8,750 was placed by Charles Koppleman, of the German Insurance Company, and $8,500 by J. Ramsay Barry. The building, which is owned by the Jenkins estate, is fully covered by insurance. The firm has secured temporary quarters at the southeast corner of Lombard and Charles streets. George K. Packham, Lewes Packham and William A. T. Packham insured proceedings against Eldridge Packham, Jr., and Harry Packham, in Circuit Court No. 2 yesterday to obtain an accounting of the business of the firm of E. Packham, Jr., & Co., dealers in glassware, barroom and bottlers' supplies. The bill of complaint was files by John P. Poe & Sons, attorneys. It states that toward the end of 1897, the firm was dissolved by agreement. the agreement provided that some time during the early part of 1898 Eldridge Packham, Jr., should account for the business to complainants and Harry Packham, so that it could be ascertained definitely what were the net profits for 1897, and the exact shares of the partners determined. Eldridge Packham, Jr., it is stated, paid $400 to each of the others in anticipation of their respective shares, and subsequently, in August, 1898, paid George K. Packham $100 additional. It is alleged that Eldridge Packham, Jr., now refuses to render any account whatever to the others, who left his employment at the end of 1898, and entered into other business arrangements. Eldridge Packham, Jr., when asked about the case yesterday, said: "at the time the complainants and I dissolved partnership I bought their entire interest in the firm assets and paid them every dollar to which they were entitled. I have for more than a year conducted the business on my sole account, and it is hardly necessary to say that the suit has nothing whatever to do with my present business. I have instructed my counsel, George Whitelock, to file an answer denying the whole claim which the complainants set up in their bill." Bridgeton Evening News (Bridgeton, New Jersey) February 15, 1899 _______________________________________________________________________________________ BOARD OF CONTROL The board of control was engaged yesterday in Finishing the purchases. Two car of beer were bought, one from the Acme Brewing Company and one from the Atlanta Brewing Company. A car of demijohns was bought from E. Packham, Jr., & Co. Fifty-five cars of bottles were bought, seventeen from the Dixie Glass Works of Tallapoosa, Ga., twenty one from the Bodine Glass Works and seventeen from E. Packham, Jr., & Co. Under an act of the Legislature just passed, the dispensary bottles are to no longer bear the representation of the palmetto tree after the supply now on hand is exhausted. The Bodine Glass Works, represented by Mr. George Packham, submitted a new design, which was examined. The bottle will be of the same shape, and the design will be the monogram "S. C. D... (South Carolina Dispensary.) Under this is "State Board of Control." It is stated as a matter of history that the first supply of bottles used by the dispensary contained a likeness of Gov. Tillman, Over 500 barrels of whiskey and other liquor was bought this time. A more than usually large amount of case goods was bought, but a smaller amount of whiskey in barrels. Judge Stockbridge, in Circuit Court No. 2, has signed a decree dismissing, with costs, the suit of George K. Packham, Lewis Packham, and William A. T. Packham, against Eldridge Packham, Jr. The suit was introduced for the purpose of obtaining an accounting for 1897 of the business of E. Packham, Jr., & Co., dealers in wine and liquor dealers' supplies. It was contended by the complainants that when the firm dissolved the defendant agreed to render them a full and particular account of the business for 1897,a nd pay them out of his net profits in addition to the stipulated sum already paid. Judge Stockbridge decided that oral evidence to establish an agreement to pay more than the stipulated sum would contradict the written contract for the dissolution of the firm, and refused to permit its introduction. John P. Poe & Sons represented the complainants and George Whitlock and Edward I. Koontz the defendant. St. Louis, Mo., April 4, 1859. Q. When did you move to Baltimore? A. I think about ’65. I remember about the time we moved to Baltimore seeing the shutters with crepe on them, and I remember now it was about the time of Lincoln’s death. Q. About ’65? A. I think so; but I do not remember within a year or two. I was younger than that, because I hadn’t started to school. Q. Tell us when the firm of E. Packham, Jr. & Co. was organized. A. Packham, DeWitt & Co. organized about 1885. Q. Were you a member of that firm? A. I was not, and had no connection with them. In 1885 I was in Cumberland, Md., in the produce business. Q. When, then, was the firm of E. Packham, Jr. & Co., of which you were a member, organized? A. I think about, possibly, 1895. I am not sure about dates. The firm of Packham, DeVVitt & Co. got into trouble. They had plenty of money, but the partners fell out and applied for a receiver. At that time I was in their employ. No, I was in the firm of Barnes & Co. Q. Manufacturers of what? A. Corks. After a tie up of three or four weeks E. Packham, Jr., my eldest brother, George Whitelock, and Judge Smeckart of the Appeal Court had it in hand. It was then, I think, I advised Mr. Barnes to withdraw from the cork business, and that firm was taken into E. Packham, Jr. & Co. It was practically the old company. Q. Then it consisted of your brother, yourself and Mr. Barnes? A. No, sir; Mr. Barnes had nothing to do with it. Q. I thought you said you induced Mr. Barnes A. To turn over the business. That firm was composed of five brothers, Eldridge Packham, Jr., Lewis Packham, George K. Packham, William A. Packham, Harry Packham. Q. When was that organized, sir; you haven’t told us what year. A. I cannot. I think, possibly, 1895 or may be in ’96, but I know that I withdrew in ’98 and formed Barnes & Co. in ’99. Q. Mr. Packham, didn’t you tell us just now that you reformed Barnes & Co. in ’89? A. No, sir; no, sir. Q. Didn’t you tell us just now that Barnes & Co. had been in the manufacturing of corks before the firm of E. Packham, Jr..& Co. was organized? A. Barnes & Co. ran a cork plant for ten or twelve years before Packham, DeWitt & Co. came into business. Mr. DeWitt traveled for Barnes. After I quit Packham, DeWitt & Co. I formed a partnership with Barnes as Barnes & Co. Mr. Barnes was manufacturing corks. We opened up a supply store on South Day Street. Mr. Barnes sold out his cork business to the Armstrong Cork Co. Q. What induced you to turn over to E. Packham & Co.? A. Mr. Barnes had been a special partner of the firm at one time. They had squeezed him out of the firm, and he was feeling rather sore, and he came to my house and got my address and wrote me, and we made a deal and I resigned my position with E. Packham, Jr. & Co. and went in with Mr. Barnes. Q. For what purpose? A. To conduct a wine and liquor dealers’ supply business. Q. Then, as I understand it, you were first with Packham—what was the style of the firm? A. After I left Cumberland, Md., I was with Packham, DeWitt & Co. Q. And then formed a partnership with Barnes & Co.? A. Yes, sir. Q. And then you left Barnes & Co.; induced them to sell their business to E. Packham, Jr. & Co.? A. Yes, sir. Q. And then you went back to Barnes & Co.? A. No, sir; Mr. Barnes Q. Didn’t you say that just now? A. No, sir. Q. Tell us just exactly how it is? A. I was in business in Cumberland, Md., in 1885 or 6, when I started. I remember leaving there in 1889. Q. In 1889; now, we have that down; where did you go when you left there in 1889? A. I went to Packham, DeWitt & Co. Q. In 1889? A. 1889; to have an inside position. I objected to traveling. Q. What do you mean by an inside position? A. A position that would not compel me to leave my wife and family and travel. Q. That was in 1889? A. 1889. Q. How long did you remain with Packham, DeWitt & Co.? A. I think that I went with Barnes & Co. about—must have been about 1895. I have made so many changes and there have been so many changes in the firms I have been with, that I am not as correct on dates as when I have those old books before me. Q. You are not as correct as you are about things down here? A. Yes, sir. Q. That is, the strength of your mind runs along finding out what you consider irregularities on the part of others? A. I have made the statement that the firms changed often and I changed-- Q. Didn’t you bring up the question about your memory yourself? A. I think I have an extraordinary good memory on some things. Q. And those things are the meddling with other people’s business, are they? A. I do not think so. I think when I come down here and put in a bid, I am entitled to a legitimate competitor's bid. Q. According to the rule prescribed by the South Carolina Legislature for those matters? A. Yes, sir; I do not say that they would do wrong. Q. Tell us about Packham, DeWitt & Co.; when you left and went to Barnes & Co. A. I cannot give you the date, but I remember that it was about 1895 that the firm of Barnes & Co. ceased and was thrown into E. Packham, Jr. & Co.'s business. Q. That is the time that you induced Mr. Barnes to sell out to E. Packham, Jr. & Co.? A. That is right. Q. Mr. Packham, where was your place of business with Barnes & Co.? A.
